DeFi Taxes Explained: Staking, LPs, Lending and Swaps

How DeFi taxes work in the US, UK, Germany and France as of October 2026: swaps, staking, liquid staking, liquidity pools, lending, liquidations and reporting.

DeFi Taxes Explained: Staking, LPs, Lending and Swaps

DeFi taxes follow the same logic as other crypto taxes: in most countries, swapping or selling a token is a taxable disposal, and rewards from staking, farming or lending count as income when you receive them. The hard cases sit in between, such as depositing into a liquidity pool, minting a liquid staking token or getting liquidated, where tax authorities have written few specific rules. This guide covers the US, the UK, Germany and France as of October 2026, so you know which questions to put to a tax professional.

The two questions behind every DeFi transaction

For each transaction, a tax authority asks two things. Did you dispose of an asset? And did you receive something new that counts as income?

In the US, the IRS treats crypto as property. Its own FAQ says that exchanging one virtual currency for another triggers a capital gain or loss, so a DEX swap is a sale. HMRC in the UK lists selling, exchanging for a different cryptoasset, paying for things and most gifts as disposals for Capital Gains Tax. Germany treats a crypto sale or swap as a private sale, taxed only if you held the coin for one year or less.

France is the exception among the four. Swaps between digital assets without a cash top-up get a tax deferral (sursis d'imposition), so tax falls due when you convert to euros or pay for goods. The French flat tax on those gains is now 31.4% (12.8% income tax plus 18.6% social charges), and you are exempt if your total sale prices for the year stay at or below €305.

How common DeFi actions are taxed

ActionUnited StatesUnited KingdomGermany
Sell a token for cashCapital gain or lossCapital gain; CGT at 18% or 24% above a £3,000 allowance (2026-27)Tax-free after one year; earlier gains taxed at your income rate unless total private-sale gains stay under €1,000
Swap one token for anotherTaxable disposalTaxable disposalCounts as a sale, same one-year rule
Staking rewardsOrdinary income at fair market value when you gain control (Rev. Rul. 2023-14)Income at sterling value when received, unless you tradeOther income; whole amount taxable once the year's total reaches €256
Deposit to a liquidity poolNo specific IRS ruleDisposal if beneficial ownership passes; "no gain, no loss" from 6 April 2027Not covered by the 2025 BMF letter
Lend tokens to a protocolNo specific IRS ruleSame test now; "no gain, no loss" from 6 April 2027Does not extend the one-year holding period
AirdropOrdinary income when received (hard fork airdrops per IRS FAQ)Usually no income tax if you gave nothing in return; income tax if received for a service; CGT when you sellNo dedicated rule found

"No specific rule" means the authority has not published guidance on that exact transaction. It does not mean the transaction is tax-free.

Swaps and DEX trades

Every swap on a DEX is a disposal of the token you gave up in the US, the UK and Germany. You work out the gain from what you paid for that token and its value at the time of the swap. A day of active trading can mean dozens of taxable events, each needing a price.

A US House bill, H.R. 10357 (the Digital Asset Tax Certainty Act), would exempt network fees of $10 or less and extend wash sale rules to crypto. The Ways and Means Committee marked it up on 16 September 2026. As of late October 2026 it has not become law.

Staking and liquid staking

The US rule for native staking comes from Revenue Ruling 2023-14. A cash-method taxpayer includes the fair market value of staking rewards in income in the year they gain "dominion and control" over them, valued at that date and time. The same applies if you stake through an exchange.

H.R. 10357 confirms that staking income is ordinary income. An earlier proposal to tax rewards only when sold, H.R. 9175, was left out of the text. On 22 October 2026 the Blockchain Association asked Congress to bring that deferral back.

HMRC taxes staking rewards as miscellaneous income at their sterling value when received, or as trading income if your staking amounts to a trade. Capital Gains Tax can apply again when you later dispose of the reward tokens.

Germany's Federal Ministry of Finance (BMF) updated its crypto guidance on 6 March 2025. Staking rewards are other income, and rewards you could have claimed by 31 December are taxable for that year even if you left them unclaimed. Staking does not stretch the one-year holding period to ten years, which an early 2022 draft had proposed.

Liquid staking adds a step. You hand coin A to a contract and get token B, a receipt that tracks your stake. Whether that hand-over is a disposal is the open question.

  • US: the IRS has published no guidance on liquid staking tokens. Notice 2024-57 told brokers they need not report wrapping, liquidity provider, staking and lending transactions while the IRS considers them. It did not say how they are taxed.
  • UK: under current guidance, HMRC asks whether you transferred beneficial ownership of the tokens. If the recipient can deal with them freely, that points to a disposal. The draft 2027 legislation does not mention staking.
  • Germany: we found no BMF rule specific to liquid staking tokens.

Liquid staking tokens also pass rewards on in two different ways. Some issue extra tokens as rewards arrive. Others keep your token count fixed and let each token become worth more of the underlying coin. With the second design, no new tokens land in your wallet, and none of the three authorities has said whether that growth is income as it accrues or part of your gain when you sell. Our post on whether crypto staking is legal covers the regulatory side.

Liquidity pools, farming and auto-compounding

When you add liquidity to a pool, you hand two tokens to a contract and receive an LP token. In the US there is no specific rule on whether that is a disposal. In the UK today, HMRC applies the beneficial ownership test above.

That changes in the UK on 6 April 2027. HMRC's policy paper on cryptoasset loans and liquidity pools, announced on 13 July 2026, treats entering and leaving these arrangements as "no gain, no loss". For automated market maker pools, a gain or loss arises only on the difference between the quantity of tokens you get back and the quantity you put in. That difference is what impermanent loss produces, so it becomes the taxable part. HMRC estimates about 700,000 people are affected.

Farm rewards are new tokens you did not hold before. No farming-specific rule exists in the US, UK or Germany, and the BMF letter leaves liquidity mining out. The closest guidance is the staking guidance above, which taxes new tokens as income on receipt. Ask your adviser whether it applies to your farm.

Auto-compounding vaults harvest rewards, sell them and add the proceeds back to your position. The questions for your adviser are whether you or the vault owns the tokens being harvested, and whether your vault share grows in value or in number.

Lending, borrowing, liquidations and NFT loans

Lending tokens to a protocol raises the same disposal question as a pool deposit. Interest or reward tokens you receive are income. From 6 April 2027, UK single-token lending moves to "no gain, no loss", and the borrowing rules set how borrowed tokens and their repayment are valued for CGT, with collateral disregarded.

Liquidations are harder. When a protocol sells your collateral to repay your debt, you lose that collateral, and in countries where a swap is a disposal the forced sale looks like one too. We found no liquidation-specific guidance from the IRS, HMRC or the BMF. Our guide to DeFi loan liquidations explains how they happen.

With NFT-backed loans, the lender earns interest, which is income. If a borrower defaults and loses the NFT, they have parted with an asset. Germany's BMF letter does not cover NFTs at all.

Airdrops and points

The IRS FAQ says new cryptocurrency received through an airdrop after a hard fork is ordinary income at its fair market value when received. In the UK, HMRC usually charges no income tax on an airdrop you gave nothing for, but charges it when the tokens reward a service, and CGT applies when you sell. Our airdrop guide explains how distributions work.

What gets reported to tax authorities

For sales from 1 January 2025, US custodial brokers report gross proceeds on Form 1099-DA. For sales from 2026 on, they also report cost basis for digital assets acquired after 2025 and held with them, per the 2026 form instructions. A separate rule that would have made DeFi front ends file these forms was repealed when President Trump signed H.J.Res. 25 on 10 April 2025. You still report DeFi activity on your own return; see our Form 1099-DA guide.

In the EU, DAC8 has applied since 1 January 2026. Crypto service providers collect data on EU-resident users and report it between 1 January and 30 September 2027. The UK started the OECD's Cryptoasset Reporting Framework on the same date, including reports on UK residents, with the first returns due by 31 May 2027. All three regimes collect data from exchanges and custodians, which is where most people move between crypto and cash. Our posts on DAC8, CARF and CRS 2.0 cover the detail.

Record keeping

Germany's 2025 BMF letter expects you to obtain transaction histories even from foreign and decentralized platforms, and it says lost data can count against you. Reports from crypto tax software are accepted if they are complete and plausible. HMRC asks for per-transaction records of token type, date, amounts, sterling value and pooled cost. The IRS requires records that support every position on your return.

For DeFi, that means keeping:

  • every wallet address you use, on every chain
  • transaction hashes for deposits, withdrawals, claims and swaps
  • the fiat value of each token at the time of each transaction, from one consistent price source
  • gas fees paid

Rules that may change soon

Three changes are in the pipeline as of October 2026. The UK's "no gain, no loss" rules start on 6 April 2027. In the US, H.R. 10357 has passed committee markup only. In Germany, the finance ministry has drafted a plan to replace the one-year tax-free holding period with a flat tax on gains for coins bought from 2027. The federal cabinet did not take it up on 14 October 2026, and the one-year rule still applies. Our crypto regulation by country hub tracks the wider rules, and the US and UK guides cover each country.

What this means for DeFi users

Using DeFi does not change what you owe. Holding your own keys means no exchange can freeze your account, and there is no sign-up or account to close. It also means nobody sends you a tax form, so the record keeping falls on you. Blockchains are public, and the exchanges you use to move between crypto and cash report under 1099-DA, DAC8 and CARF. There is no deposit insurance or ombudsman either, and smart contract, depeg and liquidation losses are yours to carry. Our explainer on DeFi regulation covers what else stays your responsibility, including sanctions.

JewelSwap is non-custodial. You connect a self-custody wallet on MultiversX, Sui or Radix, and there is no account, so your history lives at your wallet address on each chain's explorer.

Its liquid staking uses two tokens. On MultiversX, deposited EGLD mints JWLEGLD, and staked JWLEGLD becomes SJWLEGLD, which rises in value against JWLEGLD after each epoch. JWLSUI/SJWLSUI on Sui and JWLXRD/SJWLXRD on Radix use the same model. That is two token exchanges plus a value-accruing token, and your country may treat each step differently. The JWLEGLD explainer shows the mechanics. Auto-compounded farms (Scallop leveraged farms on Sui; AshSwap, xExchange, OneDex and Hatom on MultiversX) and NFT lending on MultiversX each leave their own on-chain trail of deposits, harvests and withdrawals.

Frequently asked questions

Do I owe tax on DeFi if I never cash out to fiat?

In the US, the UK and Germany, usually yes. A token-to-token swap is a taxable disposal there, and rewards count as income when received. France is different: swaps between digital assets without a cash top-up are deferred until you convert to euros or pay for something.

Are staking rewards taxed when I receive them or when I sell?

In the US and the UK, rewards are income when you receive them, and you can owe tax again on any gain when you sell. Germany taxes them as other income in the year you could claim them. The US House bill approved in committee in September 2026 left out the proposal to tax rewards only when sold.

Is minting a liquid staking token a taxable event?

No tax authority covered here has a specific rule. The IRS has published no guidance on liquid staking tokens. In the UK, it depends on whether you transferred beneficial ownership of your coins. Ask a tax professional before you rely on either answer.

Will a DeFi protocol report me to the tax authority?

The US repealed the DeFi broker reporting rule in April 2025, so DeFi front ends do not file Form 1099-DA. Exchanges and custodians do report under 1099-DA, DAC8 and CARF, and every on-chain transaction is public.

Does the UK "no gain, no loss" rule apply to my liquidity pool now?

No. It takes effect on 6 April 2027. Until then, HMRC's beneficial ownership test decides whether a pool deposit is a disposal.
